Crucial aspects of Cape Verde's penal structure are discussed below.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"cdigopenaldecaboverde\">Cape Verde Penal Code<\/h3>\n\n\n\n<p>Cape Verde's Penal Code, approved by Law no. 4\/2003 of 18 November, is the main piece of legislation governing criminal law in the country. This code defines the offences, the applicable penalties and the conditions for applying them. The Penal Code was reformulated in 2015 to bring it into line with contemporary justice and public security needs (<a href=\"https:\/\/www.governo.cv\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Government of Cape Verde<\/a>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"princpiosfundamentais\">Fundamental Principles<\/h3>\n\n\n\n<p>The Cape Verdean penal system is based on fundamental principles that guarantee justice and fairness in the treatment of individuals. These include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Principle of Legality<\/strong>No behaviour can be considered criminal unless there is a previous law defining it as such. Each category has its own specificities and associated penalties.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"crimescontraapessoa\">Crimes Against the Person<\/h4>\n\n\n\n<p>This category includes offences such as <a class=\"glossaryLink\" href=\"https:\/\/advogados.cv\/en\/glossary\/homicidio\/\" target=\"_blank\" rel=\"nofollow\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">murder<\/a><span id=\"cmttFootnoteLink10-0\" class=\"cmtt-footnote\"><sup><a class=\"et_smooth_scroll_disabled cmtt_footnote_link cmtt-footnote-deflink\" href=\"#cmttFootnoteLink10\" style=\"font-size: 14px; color: #325afb; font-style : none ;\">[10]<\/a><\/sup><\/span>, bodily injury, and sexual offences.
