The Brazilian Civil Code, established in 2002 (Law No. 10.406), replaced previous legal structures and introduced progressive changes such as reducing the age of civil majority to 18, allowing parental emancipation from the age of 16 and guaranteeing equal rights for artificial and natural children. Its structure includes a General Part, a Special Part and a Complementary Part, addressing various legal domains. The ramos do direito são construções teóricas que visam facilitar o estudo e ensino do law, mas que também apresentam aplicação concreta na sua operação pois constituem "uma forma de institucionalidade" que permite ao jurista produzir, escolher, validar e preservar o conhecimento jurídico, e também definir métodos e estabelecer padrões para delimitar, gerir e resolver "problemas juridicamente relevantes". Mais especificamente, os ramos do direito são detentores "do poder de estabelecer seus próprios principles" e, assim, desempenham um papel importante na qualidade do trabalho do jurista.
