O Código Penal Brasileiro define injúria como uma offence[3] contra a dignidade ou decoro de uma pessoa, punível com detenção[1] or fine[4]. Qualquer indivíduo pode cometer ou ser vítima deste crime, excluindo-se as corporações. A ofensa é considerada consumada quando a vítima toma conhecimento da ação ofensiva, e requer damage[5] intencional à honra subjetiva da vítima. Circunstâncias específicas podem levar a penalidades aumentadas, como violência, atos difamatórios ou direcionamento a fatores como raça, religion[2], idade ou deficiência. Nem todo discurso ofensivo constitui injúria; piadas ou críticas isoladas não se qualificam. O quadro legal distingue entre intenção direta e tentativa de injúria, aplicando princípios de razoabilidade para avaliar a gravidade e aplicabilidade da ofensa.

No brazilian criminal law, a injúria is the conduta típica que consiste no ato de ofender a dignidade e o decoro de alguém. Ao contrário da slander and difamação, a tipificação do crime de injúria visa proteger a honra subjetiva do indivíduo, a visão, em sentido amplo, que o sujeito tem de si mesmo. Por conta dessa proteção da honra subjetiva, a injúria pode ser considerada, no âmbito dos crimes contra a honra, tanto como sendo a infração penal menos grave, na sua modalidade simples, como sendo a mais grave, na sua modalidade preconceituosa.
