A Law[2] do Mercosul é um system[3] jurídico de integração que rege o Mercado Comum do Sul, classificado como um ramo único do international law[1]. Consiste em marcos normativos originais e derivados com aplicação obrigatória nos estados membros. A incorporação jurídica varia entre os países, com Argentina e Paraguai adotando uma abordagem monista onde os tratados se sobrepõem às leis nacionais, enquanto Brasil e Uruguai seguem um sistema dualista. O mecanismo de resolução de disputas evoluiu através de quatro protocolos distintos, aprimorando progressivamente os mecanismos de resolução de conflitos. O Protocolo de Olivos representa o estágio mais avançado, estabelecendo um Court[4] Permanente de Revisão e mantendo processos arbitrais. Partes privadas podem iniciar procedimentos através dos governos nacionais, embora a aplicabilidade direta permaneça desafiadora. O sistema visa harmonizar as interações jurídicas entre os estados membros, facilitando a integração econômica e regulatória no bloco regional.

1. international law. International law is a complex legal framework that governs relations between states, organisations and individuals at a global level. Emerging from historical foundations such as medieval maritime codes and the Law of Nations, it has evolved through key developments such as the Westphalian System and the establishment of the United Nations. Significant milestones include the Universal Declaration of Human Rights and the creation of international judicial bodies such as the International Court of Justice. 2. Law ( Law ) The law has evolved through complex historical stages, from ancient Egyptian and Sumerian codes to sophisticated Roman legal systems. Ancient civilisations developed organised legal structures, with significant innovations emerging in Greece and Rome. Roman law, strongly influenced by Greek philosophy, was systematically codified and subsequently rediscovered in the 11th century, forming the basis for continental European legal systems. During the Middle Ages, custom and case law replaced rigid Roman codes, with the English royal courts developing common law precedents. Modern legal systems emerged with influential codifications such as the Napoleonic and German civil codes, demonstrating increasing standardisation. Throughout history, law has been closely connected to the development of civilisation, continually adapting to changing social contexts and reflecting national identities through philosophical, cultural and professional influences.

Direito do Mercado Comum do Sul (Mercosul) é a estrutura jurídica mediante a qual funciona o Mercosul, uma organização intergovernamental of integração regional fundada a partir do Tratado de Assunção em 26 de março de 1991 e que, portanto, conta com legal personality própria. Combina, no sentido amplo do law, os clássicos treated, protocolos e declarações do international law, com legal norms próprias obrigatórias emanadas de seus órgãos decisórios, recomendações não obrigatórias emitidas pelos órgãos em geral e acordos de concertação social regional. No sentido estrito, inclui apenas aquelas normas de aplicação direta ou obrigatória para os Estados-parte, emitidas pelos órgãos decisórios.
