O procedimento penal brasileiro possui profundas raízes históricas, com sua primeira legislação codificada surgindo em 1832. O Código de Processo Penal pivotal, estabelecido em 1941 e ainda em vigor, foi fortemente influenciado pelo system[3] legal da era fascista italiana. Inicialmente autoritário, o código presumia a culpa e focava na periculosidade do acusado. A Constitution[1] de 1988 marcou um ponto de viragem significativo, introduzindo garantias individuais robustas e transformando fundamentalmente a abordagem da justice[2] criminal. Um princípio fundamental tornou-se a presunção de inocência até condenação final, deslocando o quadro legal de orientação punitiva para proteção de direitos. Esta reforma constitucional desafiou as anteriores fundações autoritárias do código, reorientando o procedimento criminal para a proteção dos direitos individuais e garantia de processos judiciais justos. Academics debate the fundamental principles of justice, examining the distribution of resources, opportunities and social goods. Symbolically represented by scales, a sword and blindfolded figures, justice embodies impartiality, balance and rational decision-making. Contemporary discourse continues to explore how justice can be achieved through legal, economic and philosophical mechanisms, recognising its dynamic and multifaceted nature.

O procedimento de legitimação do direito de punir estatal, chamado de processo penal, é o universo de estudos do Direito Processual Penal.
