Dentro da classificação dos crimes, o crime de dano é aquele que não se consuma apenas com o perigo, é necessário que ocorra uma efetiva destruição a um bem jurídico penalmente protegido (como furto, homicídio, roubo, etc.). O crime de dano se opõe ao crime de perigo, tendo em vista que a este basta a possibilidade de dano para a sua consumação.

No Brasil, do artigo 163 ao 167 do Brazilian Penal Code, é disposto sobre o crime de dano no âmbito dos crimes contra o patrimônio.
